Article 1: Scope of Application

These General Terms and Conditions of Sale (hereinafter referred to as "GTC") apply, without restriction or reservation, to all purchases of services offered by the Provider to non-professional clients ("The Clients" or "The Client") on the website https://www.eudaemonist-photography.com/ and to all sales concluded by the Seller with non-professional buyers ("The Clients" or "The Client") wishing to purchase the products offered for sale ("The Products") by the Seller on the website https://www.eudaemonist-photography.com/

 

The Services offered for sale on the website are as follows: Portrait Session, Artistic Session - Light, Artistic Session - Shadow, and Erotic Session
The Products offered for sale on the website are as follows: Photo Prints

 

The main characteristics of the Services and Products (including specifications, illustrations, and indications of dimensions or capacity of the Products) are presented on the website https://www.eudaemonist-photography.com/ The Customer is required to review these terms and conditions before placing any order.

The choice and purchase of a Service or Product are the sole responsibility of the Customer.
Product offers are subject to availability, as specified when placing the order.

These Terms and Conditions are accessible at any time on the website https://www.eudaemonist-photography.com/ and shall prevail over any other document.
The Customer declares having read and accepted these Terms and Conditions by checking the box provided for this purpose before proceeding with the online ordering process on the website https://www.eudaemonist-photography.com/.
Unless proven otherwise, the data recorded in the Provider/Seller's computer system constitutes proof of all transactions concluded with the Customer.

Customs duties, other local taxes, import duties, or state taxes may be applicable. These are the sole responsibility of the Client.

Article 2: Price

The Services and Products are provided at the prices in effect on the website https://www.eudaemonist-photography.com/ at the time the order is registered by the Service Provider/Seller.

Prices are expressed in Euros, excluding and including VAT.

The prices include any discounts offered by the Service Provider/Seller on the website https://www.eudaemonist-photography.com/.

These prices are fixed and non-negotiable during their validity period, but the Service Provider/Seller reserves the right to change prices at any time outside of this period.
Prices do not include processing, shipping, transport, and delivery fees, which are charged separately, under the conditions indicated on the website and calculated before the order is placed.
The payment requested from the Client corresponds to the total amount of the purchase, including these fees.
An invoice is issued by the Service Provider/Seller and given to the Client upon provision of the ordered Services or delivery of the ordered Products.

Article 3: Orders

The sale will only be considered valid after full payment of the price. It is the Client's responsibility to verify the accuracy of the order and to report any errors immediately.

Any order placed on the website https://www.eudaemonist-photography.com/ constitutes a distance contract between the Client and the Service Provider/Seller.
The Service Provider/Seller reserves the right to cancel or refuse any order from a Client with whom there is an existing dispute concerning payment for a previous order.
The Client can track the progress of their order on the website.

Services

The Client is responsible for selecting the desired Services on the website https://www.eudaemonist-photography.com/, according to the following procedure:
The Client chooses a Service and may select additional services, which can be added or removed before confirming their order and accepting these terms and conditions. They check availability and reserve a suitable date and time using the booking calendar for the previously selected Service. They will then add their contact information or log in to their client account. After the information has been validated, the order will be considered "pending validation." Once accepted by the Service Provider, the order will be considered final and will require payment from the Client according to the agreed terms.

Any cancellation of the order by the Client after its acceptance by the Service Provider will only be possible in the following cases:

  • Cancellation is possible up to 2 days before the scheduled date of the photo shoot.

  • Cancellation is possible between 2 days and the scheduled date of the photo shoot only in the following cases: medical emergency concerning the client or one of their immediate children (proof from an emergency medical professional must be provided); adverse weather conditions (orange/red weather alert issued by Météo-France) between the client's residence and the scheduled location of the photo shoot.

No cancellation is possible after the photo shoot has taken place, including acceptance of the order by the Provider, and until delivery has occurred (regardless of the provisions relating to the application of the statutory right of withdrawal).

Product

The Customer is responsible for selecting the Products they wish to order on the website https://www.eudaemonist-photography.com/, according to the following procedure:
The Customer chooses a Product and adds it to their shopping cart. They can then remove or modify the Product before confirming their order and accepting these terms and conditions of sale. Next, they will enter their contact information or log in to their account and choose the delivery method. After the information is confirmed, the order will be considered final and will require payment from the Customer according to the stipulated terms.

Product offers are valid as long as they are visible on the website, within the limits of available stock.

The Customer may cancel the order after its acceptance by the Seller as long as delivery has not yet taken place (regardless of the provisions relating to the application of the statutory 14-day right of withdrawal from the date the order was placed).

 

Article 4: Payment Terms

The price is payable via secure payment, according to the following methods:

  • payment by credit card

  • or payment in cash

  • or payment by bank transfer to the Seller's bank account (details of which are provided to the Customer upon placing the order)

The price of a Product is payable in full by the Customer on the day the order is placed.

The price of a Service is payable in full on the day the Services are provided, in accordance with the conditions defined in Article 5 "Provision of Services" and as indicated on the invoice given to the Customer.

 

A deposit of 25% of the total price of the Services ordered is required when the Customer places the order.

This deposit may not under any circumstances be considered a down payment.

The balance of the price is payable upon delivery of the Services, in accordance with the conditions defined in Article 5 "Provision of Services" and as indicated on the invoice provided to the Client.

Payment data is exchanged in encrypted form using the protocol defined by the approved payment provider handling the banking transactions carried out on the website https://www.eudaemonist-photography.com/.

 

Payments made by the Client will only be considered final upon actual receipt of the amounts due by the Service Provider/Seller.

The Service Provider/Seller will not be obligated to provide the Services or deliver the Products ordered by the Client if the Client does not pay the full price under the conditions stated above.

Article 5: Provision of Services

The Services ordered by the Client will be provided according to the following terms:

  1. Exchange of the booking request to confirm the session

  2. Discussion spread over several days to confirm the Artistic Direction, if applicable

  3. Reminder 3 days before the session to confirm availability: in case of oversight, unforeseen circumstances, illness, etc.

  4. Photo session

  5. Selection and post-processing of the photos, duration between 1 and 3 months maximum

  6. Sending of a private link to view all the post-processed photos with a central watermark

  7. Selection of the photos to be kept, an action performed by the model ("your body = your choice")

  8. Sending of a private link to download the selected photos in their original size with a corner watermark

  9. Use only of the selected photos in accordance with the written agreement in the contract.

The aforementioned Services will be provided within a maximum of 4 months from the final validation of the Client's order, under the conditions stipulated in these General Terms and Conditions, to the address indicated by the Client when placing their order on the website https://www.eudaemonist-photography.com/.

The Service Provider undertakes to use its best efforts to provide the Services ordered by the Client, within the framework of an obligation of means and within the aforementioned timeframes.

If the ordered Services have not been provided within three months of the estimated delivery date, for any reason other than force majeure or the Client's own actions, the sale of the Services may be cancelled at the Client's written request, in accordance with Articles L216-2, L216-3, and L241-4 of the French Consumer Code. The sums paid by the Client will then be refunded within fourteen days of the date of cancellation, without any compensation or deductions.
In the event of a specific request from the Client concerning the conditions of provision of the Services, duly accepted in writing by the Provider, the associated costs will be subject to a separate, subsequent invoice.

Unless the Client expressly raises reservations or complaints upon receipt of the Services, they will be deemed to conform to the order, in terms of both quantity and quality.
The Client will have 14 days from the date of provision of the Services to submit any complaints by mail, email, or telephone, along with all supporting documentation, to the Provider. No claim will be validly accepted if the Client fails to comply with these formalities and deadlines.
The Service Provider will reimburse or rectify, as soon as possible and at its own expense, any Services whose non-conformity has been duly proven by the Client.

Article 6: Deliveries

The Products ordered by the Client will be delivered within mainland France.

Deliveries will be made within 14 days to the address provided by the Client when placing their order on the website.
Delivery is constituted by the transfer to the Client of physical possession or control of the Product. Except in special circumstances or in the event of unavailability of one or more Products, the Products ordered will be delivered in a single shipment.

The Seller undertakes to make its best efforts to deliver the Products ordered by the Client within the aforementioned deadlines.

If the ordered Products have not been delivered within 30 days of the estimated delivery date, for any reason other than force majeure or the Customer's own actions, the sale may be cancelled at the Customer's written request, in accordance with Articles L216-2, L216-3, and L241-4 of the French Consumer Code. The sums paid by the Customer will then be refunded within fourteen days of the date of cancellation, without any deduction or compensation.

Deliveries are handled by an independent carrier to the address provided by the Customer when placing the order, provided that the carrier has easy access to this address.
When the Customer arranges for their own carrier, delivery is deemed to have been completed upon the Seller's handover of the ordered Products to the carrier, who accepts them without reservation. The Customer acknowledges that delivery is the responsibility of the carrier and has no recourse against the Seller for any failure to deliver the goods.

If the Customer requests specific packaging or shipping conditions for the ordered products, and these are duly accepted in writing by the Seller, the associated costs will be invoiced separately, based on a quote previously accepted in writing by the Customer.
The Customer is required to inspect the delivered products. They have 14 days from the date of delivery to submit any claims by mail, email, or telephone, accompanied by all supporting documentation (including photos). After this period, and if these formalities have not been observed, the Products will be deemed compliant and free from any apparent defects, and no claim will be validly accepted by the Seller. The Seller will reimburse or replace, as soon as possible and at its own expense, any delivered Products whose non-conformity or apparent or hidden defects have been duly proven by the Customer, under the conditions stipulated in Articles L 217-4 et seq. of the French Consumer Code and those stipulated in these General Terms and Conditions of Sale.

The transfer of risk of loss and damage relating thereto will only occur when the Customer takes physical possession of the Products. The Products therefore travel at the Seller's risk, except when the Customer has chosen the carrier. In this case, the risk is transferred upon delivery of the goods to the carrier.

Article 7: Transfer of Ownership

Ownership of the Products will only transfer from the Seller to the Customer upon full payment of the price by the Customer, regardless of the delivery date of said Products.


Article 8: Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, "For contracts providing for the regular delivery of goods over a defined period, the withdrawal period begins upon receipt of the first item."
The right of withdrawal may be exercised online, using the attached withdrawal form, which is also available on the website, or by any other unambiguous statement expressing the intention to withdraw, including by mail addressed to the Service Provider/Seller at the postal or email address indicated in Article 1 of these Terms and Conditions.

If the right of withdrawal is exercised within the aforementioned period, only the price of the Services ordered will be refunded.
The refund of sums actually paid by the Customer will be made within 14 days of the Service Provider's receipt of the Customer's withdrawal notification.

Returns must be made in their original and complete condition (packaging, accessories, instructions, etc.) allowing for their resale as new, and must be accompanied by the purchase invoice.
Damaged, soiled, or incomplete Products will not be accepted.

Return shipping costs are the responsibility of the Customer.

Exchange (subject to availability) or refund will be processed within 14 days of the Seller's receipt of the Products returned by the Customer under the conditions stipulated in this article.

Article 9: Provider/Seller Liability - Warranties

The Products and Services provided by the Seller/Provider are covered by:

  • the legal guarantee of conformity, for Products that are defective, damaged, or do not correspond to the order,

  • the legal guarantee against hidden defects resulting from a flaw in materials, design, or manufacturing affecting the delivered products or the performance of the ordered Services and rendering them unfit for use.

Provisions relating to legal guarantees
Article L217-4 of the French Consumer Code
"The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery." The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was their responsibility under the contract or was carried out under their supervision.

Article L217-5 of the Consumer Code
"Goods conform to the contract:

1° If they are fit for the purpose for which goods of the same type are normally used and, where applicable:
- if they correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;

- if they possess the qualities that a buyer may legitimately expect, given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;

2° Or if they possess the characteristics defined by mutual agreement between the parties or are fit for any specific purpose sought by the buyer, made known to the seller, and accepted by the seller." Article L217-12 of the Consumer Code:

"The action resulting from a lack of conformity is time-barred two years from the date of delivery of the goods."
Article 1641 of the Civil Code:

"The seller is bound by a warranty against hidden defects in the thing sold which render it unfit for its intended use, or which so diminish that use that the buyer would not have acquired it, or would have given only a lower price, if he had known of them."
Article 1648, paragraph 1, of the Civil Code:

"The action resulting from latent defects must be brought by the buyer within two years of the discovery of the defect."
Article L217-16 of the Consumer Code:

"The action resulting from latent defects must be brought by the buyer within two years of the discovery of the defect." “When the buyer requests the seller, during the term of the commercial warranty granted upon the purchase or repair of movable property, to carry out repairs covered by the warranty, any period of immobilization of at least seven days is added to the remaining warranty period. This period begins from the date of the buyer's request for service or the date the property is made available for repair, if the latter is later than the request for service.”

To assert their rights, the Customer must inform the Service Provider/Seller, in writing (email or letter), of the non-conformity of the Products or the existence of hidden defects upon their discovery.

The Provider/Seller will refund, rectify, replace, or arrange for the rectification/replacement (where possible) of any Services or Products under warranty deemed non-compliant or defective as soon as possible and no later than 14 days after the Provider/Seller has determined the non-compliance or hidden defect.
Shipping costs will be refunded based on the invoiced rate, and return shipping costs will be refunded upon presentation of proof of payment.
This refund may be made by bank transfer.

The Provider shall not be held liable or in default for any delay or failure to perform resulting from a force majeure event as defined by French law.

The Services provided through the Provider's website https://www.eudaemonist-photography.com/ comply with current French regulations.

The Seller shall not be held liable in the following cases:

  • non-compliance with the legislation of the country in which the Products are delivered and Services are provided; it is the Client's responsibility, as the sole party responsible for selecting the Products and Services requested, to verify this;

  • misuse, use for professional purposes, negligence, or lack of maintenance by the Client, as well as normal wear and tear of the Product, accidents, or force majeure.

  • The photographs and graphics displayed on the website are not contractual and shall not be binding on the Seller.

The Provider/Seller's warranty is, in any event, limited to the replacement or refund of Services actually paid for by the Client, and Products that are non-compliant or defective.

Article 10: Personal Data

The Client is informed that the collection of their personal data is necessary for the sale, performance, and delivery of Services, entrusted to the Provider; for the Products, entrusted to the Seller; and for their transmission to third parties for the purpose of Product delivery. This personal data is collected solely for the performance of the service contract or the sales contract.

10.1 Collection of Personal Data

The personal data collected on the website https://www.eudaemonist-photography.com/ are as follows:

  • Ordering Services/Products:

    • When ordering Services/Products by the Client: Last name, first name, postal address, telephone number, and email address.

    • Payment: When processing payments for Services/Products offered on the website https://www.eudaemonist-photography.com/, the website records financial data related to the Client's/user's bank account or credit card.

10.2 Recipients of Personal Data

Personal data is used by the Service Provider/Seller and its subcontractors for the performance of the contract and to ensure the efficient delivery, completion, and delivery of the service/sale.

  • Transport providers

  • Payment processing providers

10.3 Data Controller and Data Protection Officer

10.4 Limitation of Processing

Unless the Client gives their explicit consent, their personal data will not be used for advertising or marketing purposes.

10.5 Data Retention Period

The Provider/Seller will retain the data collected for a period of 5 years, corresponding to the applicable statute of limitations for contractual civil liability.

10.6 Security and Confidentiality

The Provider/Seller implements organizational, technical, software, and physical security measures to protect personal data against alteration, destruction, and unauthorized access. However, it should be noted that the Internet is not a completely secure environment, and the Provider/Seller cannot guarantee the security of the transmission or storage of information over the Internet.

10.7 Implementation of Customer and User Rights

In accordance with applicable data protection regulations, Customers and users of the website https://www.eudaemonist-photography.com/ have the following rights:

  • They can update or delete their personal data as follows: request the deletion of their personal data directly online using the form on the Contact page or via the contact information on the Legal Notice page (telephone or email).

  • They can delete their account by writing to the email address indicated in Article 10.3 "Data Controller".

  • They can exercise their right of access to know what personal data concerning them is being processed by writing to the address indicated in Article 10.3 "Data Controller".

  • If the personal data held by the Service Provider/Seller is inaccurate, they can request that the information be updated by writing to the address indicated in Article 10.3 "Data Controller".

  • They can request the deletion of their personal data, in accordance with applicable data protection laws, by writing to the address indicated in Article 10.3 "Data Controller"

  • They can also request the portability of the data held by the Provider/Seller to another provider

  • Finally, they can object to the processing of their data by the Provider/Seller

These rights, provided they do not conflict with the purpose of the processing, may be exercised by sending a request by mail or email to the Data Controller, whose contact details are indicated above.
The Data Controller must respond within a maximum of one month.
If the Client's request is refused, the refusal must be justified.
The Client is informed that in the event of a refusal, they may file a complaint with the CNIL (3 Place de Fontenoy, 75007 Paris) or take legal action. The Client may be asked to check a box indicating their consent to receive informational and promotional emails from the Service Provider/Seller. They will always have the option to withdraw their consent at any time by contacting the Service Provider/Seller (contact details above) or by following the unsubscribe link.

Article 11: Intellectual Property

The content of the website https://www.eudaemonist-photography.com/ is the property of the Service Provider/Seller and its partners and is protected by French and international intellectual property laws.
Any reproduction, in whole or in part, of this content is strictly prohibited and may constitute an infringement.


Article 12: Applicable Law - Language

These Terms and Conditions and the transactions arising therefrom are governed by and subject to French law.

These Terms and Conditions are written in French. In the event that these terms and conditions are translated into one or more foreign languages, only the French text shall prevail in case of dispute.

Article 13: Disputes

For any complaint, please contact customer service at the postal or email address of the Service Provider/Seller indicated in Article 1 of these Terms and Conditions.

The Customer is informed that they may, in any event, resort to conventional mediation with existing sector-specific mediation bodies or to any other alternative dispute resolution method (conciliation, for example) in the event of a dispute.

All disputes arising from purchase and sale transactions concluded under these Terms and Conditions, which have not been resolved amicably between the seller and the customer or through mediation, will be submitted to the competent courts under the applicable laws.
